Probably it all depends on your employment contract. But all employment contracts have a clause which clearly states that you cant be working for another organisation.
Freelancing without money or volunteering could be ok. But is always good for you to declare to your current employer to be on the safe side. Else they could still take action.
Running your startup can have both a conflict of interest or have a business interest. If your employer finds out you could be in trouble.
It all boils down to your employer but employers will take strict action because it may damage the reputation of the company.
It is common to see people moonlighting. If you are unlucky & get caught you can get fired for it. If no one comes to know it may not be a problem at all.
